The following new charter petition(s) are currently under review:
Staff recommends that the board deny the charter petition to establish TideSpeak School as a new charter school, and adopt the following written factual findings in support of a denial.
FINDINGS:
- The TideSpeak petition presents an unsound educational program for the pupils to be enrolled in the charter school, as set forth in Education Code section 47605(c)(1), due to lack of annual goals and actions to achieve the goals, lack of high school information and requirements, failure to indicate how the needs of special student populations will be met, including students achieving below and/or above grade, and failure to include a comprehensive special education plan.
- The petitioner is demonstrably unlikely to successfully implement the program, pursuant to Education Code section 47605(c)(2), as set forth in the petition because the school has presented an unrealistic financial and operational plan in the areas of administrative services, financial administration, insurance, and facilities.
- The petitioner is demonstrably unlikely to successfully implement the program, pursuant to Education Code section 47605(c)(2), as set forth in the charter petition because the petitioner is unfamiliar with the contents of the petition or the requirements of law that would apply to the proposed charter school in the areas of instructional days, instructional minutes, governance, and conflict of interest
- The petitioner is demonstrably unlikely to successfully implement the program, pursuant to Education Code section 47605(c)(2), as set forth in the petition, due to lack of necessary background in the areas of curriculum, instruction and assessment, and finance and business management.
- The TideSpeak petition does not contain the required number of signatures, pursuant to Education Code section 47605(c)(3), as petitioner was unable to confirm that the proposed charter was attached to the petition, as required by Education Code section 47605(a)(3).
- Pursuant to Education Code section 47605(c)(4), the TideSpeak petition does not contain an affirmation of each of the conditions described in Education Code section 47605(e).
- The TideSpeak petition does not contain reasonably comprehensive descriptions, pursuant to Education Code section 47605(c)(5), for 11 of the 15 required elements, including the educational program, and health and safety elements.
- The TideSpeak petition does not contain a declaration, pursuant to Education Code section 47605(c)(6), that the charter school shall be deemed the exclusive public employer of the employees of the charter school for purposes of Chapter 10.7 (commencing with Section 3540) of Division 4 of Title 1 of the Government Code.
